Independent Contractors vs Employees?

    I recently began using the services of an independent subcontractor to service 12-15 customer accounts in town. He services them Thursdays & Fridays but refuses to inform me which customers are being serviced each day. Can I require him to comply and with a chronological customer list?

    You can require the independent contractor to report this information to you as part of the sub-contracting agreement. You need to be aware, however, that many states look to the degree of control a contractor exerts over a independent contractor in determiing whether an employer-employee relationship actually exists. You could face some unintended consequences involving workers compensation and payroll taxes if you are not careful. Best contact a professional before blindly entering into these shark-filled waters.
